Meteor Ford application recommended for approval at next weeks Planning Committee


The planning application for the former Meteor Ford site at the corner of Oxford Road and St Marys Row is going back to Planning Committee next week on Thursday 3rd March. The planning application involves the creation of a food retail unit, doctors surgery and sheltered accommodation.

The planning application was previously considered by the Committee on 10th February where the Committee voted 7-6 in favour of ‘deferring the decision minded to refuse’. In plain English this was informing the Planning Officers to come back with another report providing legal reasons to refuse the planning application.

The planning officers have come back with this report – see http://www.birmingham.gov.uk/democracy/Pages/AgendaDetail.aspx?AgendaID%3d59320 – in which they are re-iterating why the Committee should approve the application. The report also contains the comments by the legal counsel acting on behalf of the applicants.

The Legal Council makes the following points:

1) The applicant will appeal against any refusal

2) If the appeal is found in favour of the applicant they will seek costs against the Council for refusing the application.

3) If costs are awarded against the Council, then a complaint will be made to the Standards Board and the Council Ombudsman for maladministration – I can only assume this would be against the Councillors who vote against the application.

4) The paragraph under the ‘District Auditor’ section is very carefully worded and I would welcome others views. My reading of this paragraph is that it is a veiled warning that the Councillors who vote against the application would be personally financially liable for any costs incurred by the Council in a successful awarding of costs against the Council. However, that’s my reading of this paragraph and would welcome others views.

Update on Moseley Road baths – 22nd February 2011

At the moment Moseley Road baths is temporarily closed. Background to this closure can be read at http://martinmullaney.blogspot.com/2011/01/update-on-moseley-road-baths-14-th.html

As of yesterday, the funds to repair the fire exit in pool 2, which in turn will allow the pool to re-open, have been released by the Council Finance department.

I will be attending a contractors meeting next week, along with Council officers, to agree start and finish dates for the repair work.

It is anticipated that the repair work will require, at most, five weeks. So allowing at least a week for the contractor to move onto site, we are mostly likely looking at an 18th April re-opening date. However, this will be confirmed next week.

The repair work is quite complex, since a structural frame will need to be constructed above the fire exit lintel so as to allow the steel lintels to the replaced. The structural frame which will be required take the weight of roof that the lintel is presenting supporting

In the meantime, the water in pool 2 is being maintained on a slow circulation. This is so as to stop the tile grout inside the pool drying out and possibly cracking, plus it maintains the sand filters.

Additional to all this, several meetings have taken place between senior Council officers to look at ways in which the restoration works for the rest of the baths could be done in phases as part of a Heritage Lottery bid.

Update on Kings Heath Library temporary closure – 18th February 2011

Work to install the permanent scaffolding, which will allow the library to re-open, will be finished on Saturday 19th February – this is one week ahead of schedule. Our plan is to re-open the library on 5th March.

Mindful that we are one week of ahead of schedule and that the library is increasingly suffering from a leaking roof – a new leak has appeared in the last week which resulted in some ceiling plaster falling onto the library below – we are using the opportunity to get a quote for putting one layer of bitumen felt across the entire flat section of the roof and hopefully having this in place by the re-opening date of 5th March.

If we can get this felt installed, this will keep the library water tight for at least 5 years, whilst we find the money to completely refurbish the roof and skylights. It will hopefully stop any more ceiling plaster falling into the library, during that period.

Between now and 5th March, the staff will be putting all the computer equipment back into the IT room and library itself – all the equipment is presently filling the entire Children’s Section.

I attach several photos, which I took on Thursday 16th February.

Photographs 1 and 2 show the permanent scaffolding

Photograph 3 shows the two boxed in vertical sections of the permanent scaffolding. The remaining vertical sections of the permanent scaffolding will be boxed in by Saturday.

Photographs 4 and 5 show the bowing of two of the skylights

Photograph 6 shows a crack in the roof felt which has allowed water to penetrate the concrete flat roof, which in turn has resulted in part of the plaster ceiling underneath to fall off into the library. You will also notice previous attempts to seal this crack with special sealing paint.

Photograph 7 is a general photograph of the flat roof. As you walk around this roof, you see small cracks in the felt, which is letting in water.

Moseley Tesco application is 'deferred minded to refuse'


The planning application for the creation of a food retail store and doctors surgery on the former Meteor Ford site on the corner of Oxford Road and St Marys Row, Moseley, was heard this morning at Planning Committee.

The planning officers recommended approval in their report. However, the Planning Committee did not agree with the report and voted (I am informed 6 votes to 5 votes) to ‘defer the decision minded to refuse’. Many of the Committee concerns revolved around traffic congestion and parking issues

What this means is that the planning officers will now be tasked with writing a report that gives legal reasons for refusing the application. It will then go back to Committee at a later date for refusal.
